Anti-Trust Compliance
It is a Realty Concepts policy that no anti-trust violation will be tolerated. Any violation of the anti-trust laws or the office preventative anti-trust policies will result in termination.
- No associate will discuss real estate commission rates with an individual from a competitor’s office or with any other licensee outside of this firm. Commissions should only be discussed with individuals within the office or with a client in the course of discussing or negotiating a listing agreement.
- No associate should discuss the services of a competitor. When asked about a competitor’s services by a potential client, the associate should stress the positive aspects about this office’s services and invite a comparison. This is the professional approach. If someone from another office wishes to discuss a fellow competitor, immediately discontinue the conversation.
- No associate should refer to a “customary”, “going”, or “usual” rate of commission or split when comparing this office’s commissions with another’s. Such words may leave the impression that there is a conspiracy to fix prices in the area. You may state what this office will charge a potential client for our services. When asked about a commission rate, stress the services that will be rendered for the payment and invite comparison with other brokers.
- If any associate has a question about a particular situation, contact management before acting. If necessary, management will consult with an attorney.
